These buyer terms apply to every vehicle bought on GreenMotion Auction from GreenMotion Solutions Kft., Rózsa utca 38/A, H-1077 Budapest, Hungary, company registration number 01-09-431703, EU VAT HU32579570 ("we"). Contact: info@greenmotion-auction.com.
The signed buyer agreement, issued after dealer verification, contains the full terms. If this page and the signed buyer agreement differ, the signed buyer agreement prevails.
1. Who can buy
- Only registered companies trading in vehicles in the EU, the EEA or Switzerland may buy. Private individuals and companies buying for their own use cannot register.
- Before an account is opened we verify the VAT number in VIES, the company registration certificate, the VAT certificate and the beneficial owners (EU Anti-Money Laundering Directive), and screen against EU sanctions lists. Approval is manual and normally takes up to 72 hours.
- We may ask for further documents at any time and block the account until they are provided. We may also block an account in case of unpaid invoices, suspected fraud or a breach of these terms.
2. Bids and conclusion of the purchase
- Every bid, maximum bid and buy-now order is binding and cannot be withdrawn.
- The purchase is concluded when the auction closes with your bid as the highest accepted bid, or when a buy-now order is confirmed.
- We may withdraw a vehicle before the auction ends and correct obvious errors in a description or price, without liability for compensation.
- Under the sourcing service with a find and bid mandate, we bid on your behalf up to the maximum hammer price you have approved in writing, never above it. Those bids are binding on you in the same way.
3. Price and fees
- Buyer fee: 1.5% of the hammer price per vehicle bought. There is no fee for registration or listing, and no subscription.
- Transport is quoted per route before you bid. Registration preparation is a fixed amount per country.
- The buyer fee and other charges are invoiced with the same VAT treatment as the vehicle.
- The landed cost shown on the website and in the portal is calculated from these items. Local taxes in your country, such as registration tax, are not included unless stated.
4. Payment
- The invoice is payable within two working days of the invoice date, by SEPA credit transfer from a bank account in the name of the buying company.
- Payment is made only to the IBAN stated in your signed buyer agreement. We never send or change bank details by email. A message asking you to pay to another account is not from us: do not pay, and contact us by phone.
- The vehicle remains our property until the invoice has been paid in full (retention of title).
- If payment has not been received after seven working days, the account is blocked. If payment has not been received after ten working days, we may cancel the sale and charge a cancellation fee equal to the buyer fee, at least €500 per vehicle. The account stays blocked until all amounts are paid.
5. VAT
- Each vehicle is listed either as VAT-qualifying or under the margin scheme. The VAT status is part of the vehicle description.
- Intra-Community supply. A VAT-qualifying vehicle delivered to a VAT-registered company in another EU member state is invoiced without VAT when (a) your VAT number is valid in VIES at the time of supply, (b) the vehicle is transported to another member state, and (c) the transport is proven. Proof consists of the CMR consignment note, signed and stamped by you on delivery, and your written confirmation of receipt stating the date and place of arrival (Article 45a of Council Implementing Regulation (EU) No 282/2011). You account for VAT on the intra-Community acquisition in your own member state.
- You return both documents to us without delay and at the latest within ten days of the end of the month following delivery.
- If the proof is not provided or is inconsistent, we are entitled to invoice the VAT of the member state where the transport began, and you must pay it.
- Margin scheme. Vehicles under the margin scheme are invoiced with margin VAT, which is not shown separately and cannot be deducted.
- Export to Norway and Switzerland. The vehicle is invoiced without VAT as an export. We file the export declaration; you handle import customs clearance and pay import VAT and any duties in your country.
- We do not deliver to the United Kingdom.
6. Transport and delivery
- We arrange transport by car carrier or professional driver, at a fixed transport price shown or quoted before you bid, to the registered address of the buying company in the EU, Norway or Switzerland. A different delivery address in the same country must be agreed in writing before the purchase.
- Self-collection, or collection by a carrier of your choice, is possible only where the listing says so or we have agreed it in writing before the purchase. The vehicle is handed over after payment has been received, you sign a handover protocol recording its condition and mileage, and risk passes to you on handover. For a VAT-free sale you must provide the confirmation of receipt and the transport or export evidence within the deadline in section 5; otherwise we invoice VAT.
- Transport starts when payment has been received. Delivery times are estimates; we are not liable for delays.
- You must be available to receive the vehicle on working days between 08:00 and 17:00. The costs of a failed delivery attempt, return transport and storage are borne by you.
- Risk passes to you when the vehicle is delivered.
- At delivery you check the vehicle and sign the CMR consignment note together with the driver. Visible damage must be noted on the CMR at delivery, as required by Article 30 of the CMR Convention. Damage not noted on the CMR is treated as having occurred after delivery.
- When a vehicle is delivered by driver, the mileage at collection and at delivery is recorded on the CMR.
7. Vehicle documents
- The registration certificate and, where listed, the certificate of conformity (CoC) are sent by tracked courier once payment, the signed CMR and your confirmation of receipt have been received.
- A CoC, service book and spare key are included only where they are listed in the vehicle description. We do not guarantee the content of a service book.
- On receipt, check the VIN, first registration date, mileage and VAT status against the invoice and report any error within two working days.
- If we have not sent the registration documents within 15 working days of receiving the signed CMR and confirmation of receipt, you may cancel the purchase.
- Registration of the vehicle in your country, including type-approval and emission requirements, is your responsibility.
8. Condition report
- Every vehicle is inspected by us on arrival: a visual and limited technical inspection with 142 checkpoints, an OBD fault-code scan and photos of visible damage. The inspection is not carried out on a lift and without dismantling, so hidden damage may not be detected.
- Battery state of health is stated only when the manufacturer exposes it via OBD, with method and date.
- The condition report describes the vehicle at the time of inspection. It is not a warranty. Vehicles are sold as inspected, with the rights set out in sections 9 to 11.
- Mileage is stated within a tolerance of ±50 km. Kilometres driven during delivery by driver, as recorded on the CMR, are added to the stated mileage and are not a discrepancy.
- For vehicles under 36 months and under 80,000 km, undeclared previously repaired damage is accepted up to €2,000 excluding VAT or 10% of the hammer price, whichever is lower. For older vehicles or higher mileage, previous damage gives no right to claim.
9. Complaints
- Transport damage and visible damage must be noted on the CMR at delivery (section 6).
- Other discrepancies from the vehicle description or condition report must be reported within five working days of delivery and before the vehicle has been driven 50 km.
- Report in writing to info@greenmotion-auction.com or in the portal, with photos of the damage and the odometer, the signed CMR, a description and the remedy you request.
- Do not repair the vehicle before we have decided on the complaint. Costs for diagnosis are borne by you unless the complaint is upheld.
- We acknowledge a complaint within one working day and aim to decide within five working days. A documented discrepancy is remedied by repair, a price reduction or cancellation.
- Claims for technical faults and for bodywork each carry a deductible of €400 excluding VAT.
- On cancellation we refund the purchase price, the buyer fee and the original transport, and we pay the return transport. Repairs, fuel and improvements are not compensated. Compensation never exceeds the purchase price.
10. Exclusions
- No claims are accepted for vehicles with a hammer price below €1,500, vehicles older than 10 years or with more than 180,000 km, or vehicles that have been registered, resold, repaired or modified after delivery.
- Wear parts, tyres, rims, glass, lights, the 12 V battery and odours are excluded.
- These exclusions do not apply to transport damage noted on the CMR, or to errors in make, model, fuel type, first registration date, mileage or VAT status.
11. Right to cancel
You may cancel the purchase if:
- the VIN does not match the vehicle description or the registration certificate;
- we cannot transfer clear title, or the vehicle is subject to an undisclosed lien or retention of title;
- make, model, fuel type or first registration date is wrong;
- the actual mileage differs by more than 2,000 km from the stated mileage;
- the VAT status differs from the vehicle description;
- the vehicle has previously been declared a total loss and this was not disclosed;
- the registration documents are not sent within the period in section 7.
12. Liability
- Our liability is limited to the purchase price and fees paid for the vehicle concerned. We are not liable for indirect loss, loss of profit or delays.
- These limitations do not apply to intent, gross negligence or injury to life, body or health.
13. Sourcing service
- A specification sent to our buyers is a request, not an order. With a find only mandate we shortlist and you bid. With a find and bid mandate we bid up to your written maximum and send you a summary before each bid.
- The sourcing service costs the same buyer fee of 1.5%, charged only when you buy.
14. Governing law and jurisdiction
- Hungarian law applies. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
- Disputes are settled by the courts of Budapest, Hungary.
- These terms are provided in several languages. The English version is binding.
